These terms and conditions of use & sale (“terms”) together with our privacy policy form a legally binding agreement (“agreement”) between you and your business (“you”) and The Bamboo Academy. These Terms of Conditions (“Agreement”) govern your use of The Bamboo Academy website (“Website”) and your relationship with The Bamboo Academy (“we,” “us,” or “our”). Each party is referred to as a “Party,” and together, we are the “Parties.”

The Bamboo Academy, The Bamboo Trader and Crypto Bamboo trademark and logo are the exclusive property of The Bamboo Academy Ltd, and their use is strictly forbidden. 

You are not granted any rights to use, copy, register as a domain name, reproduce, or display any copyrighted material, trademark, trade name, patent, trade dress, trade secret, or confidential information owned by The Bamboo Academy.

Subject to your strict adherence to these Terms, The Bamboo Academy grants you a limited, non-exclusive, non-transferable, revocable, royalty-free license to use the our website, and its content solely for personal, non-commercial purposes. This license does not permit you to download or modify any portion of our Website, except with our express written consent. You acknowledge that you do not acquire any ownership rights to the protected materials under intellectual property laws.

If you purchase a subscription to The Bamboo Academy’s software through the Website, you are granted a limited, non-exclusive, non-transferable, revocable license to use the software. You acknowledge and agree that: 

  1. The software is protected by copyright laws and is the exclusive property of The Bamboo Academy.
  1. You do not acquire any ownership rights in the software.

  1. You will not use the software to manage other individuals’ finances unless specifically licensed to do so and with written consent from the owners of The Bamboo Academy.

You agree not to use the Website or any software provided by The Bamboo Academy, either individually or in conjunction with other software or hardware, in any unlawful or harmful manner that may harm The Bamboo Academy. Furthermore, you agree not to engage in any harmful or unlawful activities on or through the Website, software, or hardware, including but not limited to:

  1. HARMFUL ACTS: Engaging in dishonest or unethical business practices, violating the law, damaging Blue Edge Financial’s reputation, hacking or conducting digital or physical attacks on the Website, and infringing upon the rights of Blue Edge Financial or any third party.
  1. “SPAMMING” AND UNSOLICITED COMMUNICATIONS: Sending or authorising spam or unsolicited communications, which includes any communications that may reasonably be considered spam or other unsolicited solicitations. Such actions will be considered a significant threat to The Bamboo Academy’s reputation and the rights of third parties. It is your sole responsibility to ensure that all business communications comply with applicable state and local anti-spamming laws.
  1. OFFENSIVE COMMUNICATIONS: Sending, posting, or authorising sexually explicit, obscene, vulgar, pornographic, offensive, profane, hateful, threatening, harmful, defamatory, libellous, harassing, discriminatory, graphically violent, or soliciting unlawful behaviour through any communication channel, including websites, social media, and blogs operated by you.

You agree to conduct yourself and your businesses in full compliance with all relevant laws, whether using The Bamboo Academy or not.

SECTION 3 – OUR PRIVACY POLICY AND YOUR PERSONAL INFORMATION

At The Bamboo Academy, we highly value your privacy and the secure handling of your non-public, personal information. SECTION 4 – ORDER PLACEMENT AND ACCEPTANCE

If you place an order for a service or product at The Bamboo Academy, payment must be made in advance before we can accept your order. In the event that any required information is missing or inaccurate, we may request additional details, and we reserve the right to cancel or restrict an order after it has been placed. Please note that receiving an electronic order confirmation or any form of confirmation does not indicate our acceptance of your order. To modify or cancel a pending order, you must contact us immediately at support@thebambooacademy.com. However, we cannot guarantee that we will be able to make changes to your order as per your instructions.

Please be aware that all items are subject to availability. If any item is unavailable, we will inform you of the expected availability date and may provide you with an alternative product or service. If you do not wish to substitute the product or service due to a delay in availability, you may request the cancellation of your order. In such cases, if your payment card has already been charged, we will issue a full refund for that specific order. We reserve the right to restrict the sale of our products and services to certain individuals, geographic regions, or jurisdictions. This right may be exercised on a case-by-case basis at our sole and exclusive discretion.

Please note that your purchase order for products and other services is subject to your reaffirmation of acceptance of this Agreement.

All prices displayed and payments made for The Bamboo Academy’s products and services are in Great British Pounds.

SECTION 5 – INFORMATION YOU PROVIDE; REGISTRATION; PASSWORDS; PROHIBITION AGAINST HOSTING THIRD-PARTY AGENCY ACCOUNTS

As a user of The Bamboo Academy, you will need to create an account with us. It is important that the information you provide during registration is accurate and truthful, and that you are not pretending to be someone else. Safeguarding the confidentiality of your password for accessing your user account is your responsibility, and you agree not to share, transfer, or allow any third party to use your password or user name. You are fully accountable for all interactions and information transmitted to The Bamboo Academy under your user account. If you suspect any unauthorised use of your password or user name or any breach of account security, promptly notify The Bamboo Academy. Failure to comply with these obligations will absolve The Bamboo Academy of liability, and you agree to hold The Bamboo Academy harmless for any loss or damage incurred.

SECTION 6 – REFUND, AUTOMATIC ENROLMENT & PAYMENT, & CANCELLATION

At The Bamboo Academy, we reserve the right to modify the monthly membership subscription rate at any time. If there are changes to the subscription rate after you have subscribed, we will send you an email notification and provide an opportunity for cancellation. Should you decide to cancel your subscription, please follow the instructions in our knowledge base article “How do I cancel?” or reach out to us through live chat at www.thebambooacademy.com to request cancellation. It is important to initiate the cancellation process at least one day before your upcoming subscription due date to avoid any charges on your credit card. When canceling your account, you can choose to terminate it immediately or by your next due date. Please note that there is no pro-rating if you opt for immediate termination. Failure to cancel at least one day before the next due date will result in the automatic continuation of your subscription. Your provided payment card will be charged the full monthly membership subscription rate as originally enrolled until you decide to cancel.

SECTION 7 – SUBSCRIPTION TERMS AND AUTOMATIC PAYMENT

As a member of The Bamboo Academy, you are responsible for fulfilling all payment obligations associated with your monthly subscription as outlined in these Terms. The initial fee must be paid upon setting up your user account, and access to our services is contingent upon payment of the monthly fee. Each month, your account will be automatically charged the subscription fee for the following month, along with any applicable taxes and additional fees for that period, as well as any outstanding charges from the previous period (collectively referred to as “Fees”). Non-utilisation of The Bamboo Academy’s services does not exempt you from your payment responsibilities under these Terms.

We offer convenient payment options, including credit card and debit card. To ensure the security of your financial information, we collect payment details through our secure data collection system. By agreeing to these Terms, you acknowledge that we store transaction data, such as the last four digits and expiration date of the card used for purchase, as well as information about payment due dates. You further authorise the automatic collection of recurring payments in accordance with the payment terms specific to the service you have purchased (unless you cancel your subscription as per these Terms), such as monthly payments of a designated amount.

IF YOU ARE A MEMBER OF THE BAMBOO ACADEMY WITH A MONTHLY SUBSCRIPTION AND HAVE PROVIDED US WITH A VALID CREDIT CARD NUMBER, DEBIT CARD NUMBER, OR ALTERNATE PAYMENT METHOD, EACH PAYMENT WILL BE AUTOMATICALLY PROCESSED ON YOUR SPECIFIED PAYMENT DATE (MONTHLY) AND CHARGED TO THE PROVIDED PAYMENT METHOD. IF YOU WISH TO CANCEL YOUR SUBSCRIPTION TO THE BAMBOO ACADEMY, YOU CAN DO SO THROUGH YOUR ACCOUNT DASHBOARD OR BY SENDING AN EMAIL TO SUPPORT@THEBAMBOOACADEMY.COM AT LEAST TEN (10) DAYS PRIOR TO THE START OF YOUR NEXT SUBSCRIPTION MONTH.

The Bamboo Academy Ltd reserves the right to terminate your account and/or service immediately for any unpaid portion or duration of your subscription, with or without notice. Termination of service does not exempt you from fulfilling outstanding charges or expenses. In the event that The Bamboo Academy initiates any collection processes, you will be held responsible for all associated costs, including legal fees and expenses, as stated in Section 20 below.

Additionally, The Bamboo Academy Ltd may apply applicable value-added or other taxes in addition to the Fees.

SECTION 8 – LIMITATIONS OF LIABILITIES

EXCEPT WHERE OTHERWISE INAPPLICABLE OR PROHIBITED BY LAW, IN NO EVENT SHALL THE BAMBOO ACADEMY OR ANY OF ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, INDEPENDENT CONTRACTORS, TELECOMMUNICATIONS PROVIDERS, AND/OR AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL, PUNITIVE, OR ANY OTHER DAMAGES, FEES, COSTS OR CLAIMS ARISING FROM OR RELATED TO THIS AGREEMENT, THE PRIVACY POLICY, THE SERVICES OR PRODUCTS, YOUR OR A THIRD PARTY’S USE OR ATTEMPTED USE OF THE WEBSITE OR ANY SOFTWARE, SERVICE, OR PRODUCT, REGARDLESS OF WHETHER THE BAMBOO ACADEMY HAS HAD NOTICE OF THE POSSIBILITY OF SUCH DAMAGES, FEES, COSTS, OR CLAIMS. THIS INCLUDES, WITHOUT LIMITATION, ANY LOSS OF USE, LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, COST OF PROCUREMENT OF SUBSTITUTE SERVICES OR PRODUCTS, OR ANY OTHER INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, CONSEQUENTIAL, OR OTHER DAMAGES. THIS APPLIES REGARDLESS OF THE MANNER IN WHICH DAMAGES ARE ALLEGEDLY CAUSED, AND ON ANY THEORY OF LIABILITY, WHETHER FOR BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), WARRANTY, OR OTHERWISE.

IN NO EVENT SHALL THE BAMBOO ACADEMY’S LIABILITY TO YOU OR YOUR BUSINESS EXCEED THE AMOUNT OF THREE (3) TIMES THE PAYMENTS PAID BY YOU TO THE BAMBOO ACADEMY FOR THE MONTH PRECEDING THE DATE IN WHICH THE FACTS GIVING RISE TO A CLAIM AGAINST THE BAMBOO ACADEMY OCCURRED OR THREE HUNDRED POUNDS (£300.00), WHICHEVER IS GREATER.

SECTION 9 – DISCLAIMERS OF OTHER WARRANTIES

EXCEPT WHERE OTHERWISE INAPPLICABLE OR PROHIBITED BY LAW:

THE BAMBOO ACADEMY WEBSITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE MAKE NO, AND EXPRESSLY DISCLAIM ANY AND ALL, REPRESENTATIONS AND WARRANTIES AS TO THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, AVAILABILITY, ACCURACY, AND/OR COMPLETENESS OF ANY INFORMATION ON THIS WEBSITE.   1. (E) ERRORS OR DEFECTS IN THE WEBSITE WILL BE CORRECTED.

THIS IS A BINDING AGREEMENT. THIS AGREEMENT GOVERNS YOUR ACCESS TO AND USE OF THE WEBSITE AND THE SERVICES PROVIDED BY THE BAMBOO ACADEMY, ANY ORDER YOU PLACE THROUGH THE WEBSITE, BY TELEPHONE, OR OTHER ACCEPTED METHOD OF PURCHASE AND, AS APPLICABLE, YOUR USE OR ATTEMPTED USE OF THE PRODUCTS OR SERVICES OFFERED ON OR AVAILABLE THROUGH THE WEBSITE.

THIS AGREEMENT CONTAINS ARBITRATION AND CLASS ACTION WAIVER PROVISIONS THAT WAIVE YOUR RIGHT TO A COURT HEARING, RIGHT TO A JURY TRIAL, AND RIGHT TO PARTICIPATE IN A CLASS ACTION. ARBITRATION IS MANDATORY AND IS THE EXCLUSIVE REMEDY FOR ANY AND ALL DISPUTES
